Short Term Rental
In 2016, Denver City Council adopted an ordinance requiring the licensure of short-term rentals and creating requirements that short-term rental licensees must comply with.
Key features of Denver’s short-term rental laws, rules, and regulations:
All short-term rentals must be licensed.
Any short-term rental must be the host’s primary residence*
All advertisements for short-term rentals must display the host’s business license number.
All short-term rental hosts must abide by rules related to safety, taxes, zoning, and insurance.
Failure to follow the rules can result in fines or other penalties, including license revocation
*Primary residence means the place in which a person's habitation is fixed for the term of the license and is the person's usual place of return. A person can have only one (1) primary residence.
2020 SHORT-TERM RENTAL LEGISLATION
In 2019, the Denver STRAC (Short Term Rental Advisory Committee) discussed and offered several legislative recommendations to enhance the city’s short-term rental ordinance and keep pace with the evolution and growth of the industry, both in Denver and across the globe.
Key recommendations from the group included:
Pursuing changes to the ordinance in two phases, with the first phase focused on updating existing language, and the second phase focused on adding new requirements.
In the first phase, which has been completed in the first quarter of 2020, changes include strengthening the existing primary residence requirement to protect our largely compliant Denver host community from unfair competition, and to protect neighborhoods from mini-hotels and the negative effects of commercial encroachment.
In the second phase, which the committee will be discussing throughout 2020, recommended changes include the creation of new requirements for booking platforms and property managers, both of which are currently unregulated.
